The Born_Oppenheimer approximation would not be valid in the case that the nuclei are moving fast enough so that their movement cannot be neglected compared to that of the electrons. In some solids for example, the nuclei can move around which leads to conductivity, this cannot be modeled under the Born-Oppenheimer approximation.
